By virtue of Section 28 (5) (b) of the Land Use Act, one of the grounds for the revocation of a Certificate of Occupancy is a Breach of terms contained in the Certificate of Occupancy.
The Certificate of Occupancy makes provision for a yearly payment of GROUND RENT to the Governor of a State. One of the monies subsumed in the Land Use Charge is the ground rent.
As such, failure to pay Land Use Charge is a breach of a term of the Certificate of Occupancy and a ground for revocation of your Certificate of Occupancy.
If you feel your Land Use Charge is unreasonably high, you can write to the Land Use Charge Appeal Tribunal for a review. Tope Babade & Co (Real Estate Consultants) is available to give real estate investment advisory service to you in that regard. Thank you.
