The required length of time for a Notice to Quit depends on the type of tenancy in question. The nature of the tenancy is determined by the Tenancy Agreement, the frequency of rent payments by the tenant, or the period within which rent is demanded by the landlord.
Under the Lagos State Tenancy Law, the notice periods are as follows:
• Tenant at will – One (1) week notice
• Monthly tenant – One (1) month notice
• Quarterly tenant – Three (3) months notice
• Half-yearly tenant – Three (3) months notice
• Yearly tenant – Six (6) months notice
For a fixed-term tenancy, no Notice to Quit is required, as the tenancy automatically expires by law at the end of the agreed term. However, if the tenant remains in possession after the expiration of the fixed term without a renewal, the landlord will issue a seven (7) days’ notice of owner’s intention to recover possession before initiating eviction proceedings in court.
